FireAnalysis.net Privacy Policy and User Agreement

FireAnalysis.net's policy and user agreement (hereinafter "agreement") is intended, in part, to respect and protect the privacy of our users. 1. OPTING-OUT

As the information you provide at the time of registration or submission is required to fulfill the fiduciary responsibilities to our clients and to conduct research, there is no way to "opt out" of providing this information for our use.

Your FireAnalysis.net account is password protected so that only you, designated representatives from your company, our staff, and/or our clients can access it and view the member information relevant to the account. You are not to divulge your password to any unauthorized third party. If you knowingly provide your login and password information to another unauthorized person, your account privileges may be suspended temporarily or terminated. We will never ask you for your password in an unsolicited phone call or email. Ultimately, you are responsible for maintaining the secrecy of your passwords and any account information. Remember to sign out of your account and close your browser window when you have finished your work. This is to ensure that others cannot access your personal information and correspondence if your computer is accessible to others or if you share a computer with someone else or are using a computer in a public place. You agree to immediately notify FireAnalysis.net verbally and in writing of any unauthorized use of your password or account or any other breach of security. FireAnalysis.net and its parent company, Fire Consulting & Case Review International, Inc. will not be liable for any loss or damage arising from your failure to comply with this section. You are responsible for disabling user accounts of terminated employees.

6. PROPRIETARY RIGHTS

FireAnalysis.net reserves all rights, title and interest in and to this service and the online documentation. You shall not take any action to jeopardize, limit, or interfere with the ownership by FireAnalysis.net and its rights with respect to the service and online documentation. You acknowledge that any unauthorized copying or unauthorized use of this service or online documentation is a violation of this Agreement and copyright laws and is strictly prohibited.

7. RESERVATION OF RIGHTS

All rights not expressly granted herein are reserved to FireAnalysis.net, and no other licenses are granted herein by implication, estoppels or otherwise. FireAnalysis.net does not grant any license or other rights to any of its intellectual property other than the rights to use the service and online documentation specifically granted in the Agreement, and all other rights are reserved by FireAnalysis.net.

8. UPGRADES AND UPDATES

FireAnalysis.net in its sole discretion reserves the right at any time to add additional features or functions, or to provide programming fixes, updates and upgrades to this service. You acknowledge and agree that FireAnalysis.net, in its sole discretion, may modify, discontinue or suspend your ability to use this service, or disable any service you may already have accessed without any notice to you, for the repair, improvement, or upgrade of the underlying technology, or to maintain proper operation or security of this service.

9. DISCLAIMER OF WARRANTIES

This service is provided "as is" and there are no warranties, claims or representations made by FireAnalysis.net, either express, implied or statutory, with respect to the service provided including, without limitation, warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose, nor are there any warranties created by conduct, or trade custom. FireAnalysis.net makes no representation or warranty that the service will always be available, accessible, uninterrupted, timely, secure, accurate, complete or error-free.

10. LIMITATION OF LIABILITY

In no event shall FireAnalysis.net or its parent company, Fire Consulting & Case Review International, Inc., be liable whether in contract, warranty, tort (including but not limited to negligence, whether active, passive or imputed, product liability, strict liability, or other theory) for any direct, indirect, incidental, special or consequential damages (including without limitation, any failure to process information from or to the user in a timely manner, any loss of data, service interruption, computer failure or pecuniary loss) arising out of your use or inability to use this service, or FireAnalysis.net's breach of the agreement in excess of an aggregate of $100 for any and all claims arising out this agreement, even if FireAnalysis.net has been advised of the possibility of such damages.

11. GENERAL PROVISIONS

FireAnalysis.net reserves all rights not expressly granted herein. FireAnalysis.net may modify the agreement at any time by providing you notice of the same. Your continued use of this service constitutes your acceptance of the revised agreement. No modification of the Agreement however, shall affect either party's rights or duties existing prior to the modification. FireAnalysis.net may assign this agreement or delegate any of its duties under this agreement. You may not assign this agreement or any rights hereunder. Nothing in this agreement shall constitute a partnership or joint venture between you and FireAnalysis.net. Should any term or provision hereof be deemed invalid, void or unenforceable either in its entirety or in a particular application, the remainder of this agreement shall nonetheless remain in full force and effect. Any legal proceeding arising out of or relating to this agreement will be subject to the exclusive jurisdiction of any state court sitting in Johnson County, Kansas or federal court in the state of Kansas. The agreement shall be governed by and construed in accordance with the laws of the State of Kansas without regard to its conflict of law rules. The terms set forth in this agreement and any related service agreements constitute the final, complete and exclusive agreement with respect to this service and cannot be contradicted, explained or supplemented by evidence of any prior agreement, any contemporaneous oral agreement or any consistent additional terms.

12. YOUR ACCEPTANCE OF THESE TERMS

By using this Web site, you expressly acknowledge that you have read this agreement and understand the rights, obligations, terms and conditions set forth herein. By using this Web site / service, you expressly consent to be bound by its terms and conditions set forth in this agreement. Your continued use of our site following the posting of changes to these terms will mean you accept those changes. The person consenting to this agreement represents and warrants that he or she has the power to bind the entity on whose behalf consent is granted to this agreement. This agreement will remain in effect until terminated by either party. FireAnalysis.net may terminate this agreement at any time, with or without cause, by not providing to you and/or preventing your access to this web site and service. Upon termination of this agreement for any reason, all licenses and rights to use this service shall terminate and you must cease using this service. Sections 1, 6a, 6b, 7, 8, 10, 11, 12, and 13 shall survive such termination.

YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND UNDERSTAND THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH HEREIN. BY USING THIS WEB SITE / SERVICE, YOU EXPRESSLY CONSENT TO BE BOUND BY ITS TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT. THE PERSON CONSENTING TO THIS AGREEMENT REPRESENTS AND WARRANTS THAT HE OR SHE HAS THE POWER TO BIND THE ENTITY ON WHOSE BEHALF CONSENT IS GRANTED TO THIS AGREEMENT.
